General terms and conditions of business
1. Scope
The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Contracting parties, conclusion of contract, correction options
The purchase contract is concluded with MyBudapester, Shoepassion GmbH, Wolfener Str. 32-34, 12681 Berlin, Germany.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the "Buy Now" button, you submit a binding offer for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit your order.
We usually accept your offer within two days by
- we submit a declaration of acceptance in a separate email or
- if applicable, the payment transaction by our service provider or the
selected payment service provider.
The time of execution of the payment transaction depends on the
the selected payment method (see “Payment”).
The alternative that is relevant to you depends on which of the listed events occurs first.
We are entitled to reject an offer from you without giving reasons, in particular if there is reasonable suspicion that the goods purchased via the Internet will be resold commercially.
3. Cancellation policy
1. RevocationConsumers have a right of withdrawal of 14 days.
“Consumers” within the meaning of the Consumer Protection Act (KSchG) are natural persons with whom we enter into business relations without them being able to be attributed an independent economic activity.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial shipment or the last item.

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.
2. Consequences of revocation
If you cancel this contract, we will refund all payments (except for delivery costs) that we have received from you promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. With regard to the goods to be returned, we agree with you to retain title in your favor until your payments have been repaid.
You will not bear the direct cost of returning the goods if you use the return label provided by us (by clicking on the link in the shipping confirmation email we sent you or by requesting it via kontak@mybudapester.com, stating your order details).
If you do not use the return label we provide – i.e., send the package freight collect or pay postage at a post office – you will be responsible for any costs incurred in doing so.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Different return costs for Germany, Austria, Switzerland
We will bear the direct costs of returning the goods if the return is made within Germany, Austria or Switzerland.
Return labels
Without prejudice to your statutory rights, we provide you with free return labels for your return within Germany, Austria, or Switzerland. The return label will be enclosed with your shipment. You can drop off the return shipment at a parcel shop of the respective provider in Germany, Austria, or Switzerland.
3. Return
3.1 For returns with an order value of less than €300 (within Germany) or €500 (within the EU), we charge a flat rate equal to the shipping costs incurred for the order. These costs are therefore non-refundable. For orders with a value of more than €300 (within Germany) or €500 (within the EU), MyBudapester, Shoepassion GmbH will cover the return shipping costs, provided the following conditions are met:3.2 Returns of goods are only accepted via the shipping service provider that delivered the package (DHL), and the waybill or label included in the package must be used. All documents that may be helpful for the return are included with your package. (The waybill for returns is only included within Germany. For other countries, please contact our customer service.)
3.3 Shoes that are indicated as custom-made in the product description are excluded from the right of return and exchange.
3.4 Please note that we can only accept returns from the respective country of delivery. For example, if the delivery was made to Austria, the return can only be initiated from Austria.
3.5 In the event of a return, a credit will be issued to the payment method used for the order; any losses due to currency fluctuations will not be refunded.
3.6 Returns must be made to the respective partner shops; the address details can be found on the shipping label.

This voluntary right of return does not limit your statutory rights and therefore does not limit your right of cancellation as described above.
4. PRICES; PRODUCT PRESENTATION; AVAILABILITY; PROMOTION CODE
1. The prices listed on our website www.mybudapester.com at the time of your order apply.2. The goods offered on Mybudapester.com are presented on the website as digital photographs of the actual goods. Minor deviations between the representation and the actual product do not constitute a defect in the ordered goods.
3. If you have ordered multiple products at the same time, the individual products may be delivered at different times. Section 266 of the German Civil Code (BGB) remains unaffected. Shipping costs will only be charged once.
4. Promotion Code
4.1 Promotion codes have different validity periods and are applicable to the purchase of items specified by the promotion code. The specific validity period of your promotion code can be found in the document that also contains the promotion code. If it is displayed on the website, you can find the terms and conditions by clicking on the promotion code.
4.2 The exchange or cashback of promotional codes received from Mybudapester.com as part of marketing campaigns or as a goodwill gesture is excluded. Cashback of other promotional codes is also excluded, outside of your statutory rights of return and withdrawal.
4.3 Mybudapester.com reserves the right to cancel or block the Promotion Code if there is a legitimate reason for doing so, such as in the event of loss or misuse of the Promotion Code. Mybudapester.com will notify you of the cancellation or blocking of the Promotion Code.
4.4 Information on returning items from orders with a promotional code:
If you exercise your right of withdrawal or voluntary right of return, you will be refunded the discounted purchase price. If you cancel or return an item from an order that originally contained multiple items, the value of the promotional code will be deducted proportionately from the total price of the item, and you will receive the corresponding refund. The promotional code expires in proportion to the value of the returned item. If you cancel or return all items, the promotional code expires, and the original amount paid will be refunded. There is no entitlement to a refund or replacement of a promotional code from a promotion.
5. Payment via promotion code
5.1 Payment via promotional code is made by entering the promotional code in the designated field during the order process and then clicking the "Apply Code" button (order step "Shopping Cart"). If the order value exceeds the value of the promotional code, you must also select one of the offered payment methods to pay the remaining amount.
5. Contract language, contract text storage
The language(s) available for the conclusion of the contract: GermanWe save the contract text and send you the order details and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible online.
6. Delivery conditions
Shipping costs may apply in addition to the stated product prices. Further details regarding applicable shipping costs can be found in the respective offers.We only ship by mail. Unfortunately, pickup is not possible.
7. Payment
In our shop you can generally use the following payment methods:Credit card (Visa, MasterCard, American Express)
During the ordering process, you enter your credit card details. Your card will be charged immediately after you place your order.
PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed by PayPal immediately after you place your order. Further information will be provided during the ordering process.
Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe SCA, 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed within one banking day after placing the order. A banking day is every working day, except for Saturdays, federal public holidays, and December 24th and 31st of each year. Further information will be provided during the ordering process.
8. Retention of title
The goods remain our property until full payment has been made.9. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us will have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you will help us assert our own claims against the carrier or transport insurance.10. Warranty and Guarantees

11. Liability
We are always liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents- in case of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,
- in the case of guarantee promises, if agreed, or if the
Scope of application of the Product Liability Act is opened
- in case of breach of essential contractual obligations, the fulfilment of which
proper execution of the contract is possible in the first place and
on whose compliance the contractual partner can regularly rely,
(cardinal obligations) due to slight negligence on our part, our legal
Representatives or vicarious agents, the liability is limited to the amount
The damage is limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which
typically has to be expected.
Otherwise, claims for damages are excluded.
